Client Responsibilities & Disclosures
Clear expectations and limitations for ApexCare Governance™
Client Responsibility
ApexCare Governance™ provides structured documentation and regulatory monitoring to support compliance efforts.
Clients remain responsible for:
- • Implementing and maintaining compliance with applicable regulations
- • Ensuring staff training and operational execution
- • Maintaining accurate and complete operational records
- • Seeking legal or regulatory counsel when needed
- • Adapting system documentation to their specific operations
Monitoring Limitations
ApexCare Governance™ provides structured regulatory monitoring within defined parameters:
Scope Limitation
Primary monitoring covers Texas state-level regulations and applicable federal regulations only. Other states may be available upon request.
Cadence Limitation
Monitoring follows a quarterly review cadence with ad hoc review for significant developments. This is not real-time monitoring.
Coverage Limitation
Monitoring does not cover all regulatory changes in all jurisdictions. Clients must supplement with their own monitoring as needed.
Interpretation Limitation
ApexCare identifies regulatory changes but does not interpret regulations or provide legal advice on compliance requirements.
No Legal Advice
ApexCare Governance™ does not provide legal advice.
The system provides structured documentation and regulatory monitoring to support compliance efforts, but does not:
- ✗ Interpret regulations or provide legal opinions
- ✗ Replace the need for legal or regulatory counsel
- ✗ Provide guidance on specific compliance situations
- ✗ Advise on regulatory strategy or risk management
Clients should consult qualified legal or regulatory counsel for interpretation, advice, and compliance strategy.
No Compliance Guarantees
ApexCare Governance™ does not certify compliance or guarantee inspection outcomes.
The system supports compliance efforts by providing:
- • Structured documentation frameworks
- • Standardized procedures and templates
- • Regulatory monitoring and update notifications
However, compliance outcomes depend on implementation, staff execution, operational practices, and regulatory interpretation by authorities. ApexCare cannot guarantee specific inspection results or compliance status.
Audit Readiness Clarification
ApexCare Governance™ supports audit readiness by providing structured documentation and operational frameworks.
Audit readiness means:
- • Documentation is organized and accessible
- • Procedures are clearly defined and documented
- • Operational records follow consistent standards
- • Regulatory awareness is maintained through monitoring
Audit readiness does NOT mean:
- ✗ Guaranteed audit success or compliance certification
- ✗ Audit preparation services or inspection support
- ✗ Representation during regulatory inspections
System Positioning
ApexCare Governance™ is designed to support compliance efforts, not assume operational responsibility.
The system provides structure, documentation, and regulatory awareness. Clients retain full responsibility for compliance implementation, staff training, operational execution, and regulatory adherence.
